Welcome to oneTRIBE. These Terms and Conditions ("Terms") govern your use of our mobile application ("Mobile App"). By accessing or using our Mobile App, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use our Mobile App.
You must be at least 18 years old to use our Mobile App. By using the Mobile App, you represent and warrant that you meet this requirement.
To access certain features of our Mobile App, you may be required to create an account and provide certain personal information. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary to keep it accurate, current, and complete.
You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account.
You agree not to engage in any of the following activities while using our Mobile App:
Your use of our Mobile App is also governed by our Privacy Policy, which can be found within the Mobile App. By using our Mobile App, you consent to the practices described in the Privacy Policy.
The Mobile App and its entire contents, features, and functionality, including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof, are owned by oneTRIBE, its licensors, or other providers of such material and are protected by intellectual property laws.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Mobile App for your personal, non-commercial use.
We reserve the right to terminate or suspend your account and access to the Mobile App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Mobile App, us, or third parties, or for any other reason.
The Mobile App is provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, as to the operation of the Mobile App or the information, content, materials, or products included on the Mobile App.
To the fullest extent permitted by law, oneTRIBE, its affiliates, and their respective officers, directors, employees, agents, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Mobile App, even if advised of the possibility of such damages.
You agree to defend, indemnify, and hold harmless oneTRIBE, its affiliates, and their respective officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Mobile App.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which oneTRIBE is headquartered, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the Mobile App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms within the Mobile App. Your continued use of the Mobile App after any such changes constitutes your acceptance of the new Terms.
